Manslaughter Laws in OK
Violent crimes, including acts of homicide, are classified by degrees—first degree
and second degree. Manslaughter is also classified as either a first-degree
or second-degree charge.
First-degree manslaughter is defined as the following:

- The killing occurs “in the heat of passion” or when using a
- The individual exerts unnecessary force in avoiding a crime or after a
- Killing another person while under the influence
Second-degree manslaughter is defined as the following:
- Involuntary, or unintentional killing of another person
- Committed while committing an act of criminal negligence or recklessness
An example of second-degree manslaughter if the owner has a pet dog who
is known to be ferocious and prone to attack. The owner keeps the dog
chained in his yard, but the dog breaks free and mauls another person.
That person then dies from the injuries. Therefore, the owner would be
considered culpable in a second-degree manslaughter situation.
By law, prosecutors must prove that the death occurred because of the accused
