credit or debit card fraud is committed when a person (1) uses fraud or
deception to seize or use someone else credit or debit card information,
(2) uses someone else’s credit or debit card without permission
to purchase goods, property, or services, (3) uses someone else’s
personal information to open a credit or debit card account, (4) uses
a credit or debit card that is invalid or revoked, or (5) receives credit
or debit that belongs to someone else with the intention to use or sell the card.

Credit Card Fraud Penalties
It is considered a misdemeanor if a person knowingly uses or attempts to
use a credit or debit card in order to purchase goods, property, or services,
as well as obtain cash advances or transfer funds. If the amount fraudulently
acquired is less than $500, the crime is punishable by a jail sentence
of 30 days and/or a fine of up to $500. If the amount fraudulently acquired
is over $500, the crime is punishable by a prison sentence of one year
and/or a fine between $500 and $1,000.
It is considered a felony if you take a credit or debit card from another
person without their consent, receive a credit or debit card which you
know has been stolen in order to use it, selling or buying credit or debit
cards, and forging credit or debit cards. All credit card fraud felonies
are punishable by a prison term of up to three years and/or a fine of
up to $3,000.
